Terms and Conditions

1. What Mietbar is

Mietbar is an online marketplace where users (“owners”) offer items for rent and other users (“renters”) can request and rent them.

The rental contract is concluded exclusively between owner and renter. Dinusha Rasangi is not a party to it, does not own the items offered and gives no guarantee for their condition, availability or legality.

2. Sign-up and account

• You must be at least 18 years old and have full legal capacity.
• Your details must be true and up to date. Each person may only have one account.
• Keep your password secret. You are responsible for all activity in your account.
• Businesses renting out items commercially must state this in their profile and fulfil the obligations for businesses themselves (e.g. imprint, cancellation policy).

3. Listings

As an owner you confirm that you are entitled to rent out the item and that its description, photos, prices and deposit are true. In particular, the following must not be offered:

• weapons, ammunition, fireworks and hazardous substances
• drugs, medicines, alcohol and tobacco
• stolen, counterfeit or unlawfully obtained items
• animals
• items whose use requires a permit the renter cannot show
• anything that violates applicable law or the rights of others

4. Requests, booking and handover

• The renter sends a rental request for specific days. When the owner accepts it, the rental contract is concluded on the terms shown.
• Both sides can cancel a request or a confirmed booking before the rental starts. Please cancel as early as possible.
• You agree on handover and return between yourselves. Check the item's condition together at handover and return, ideally documented with photos.
• The renter treats the item with care, uses it only as intended and returns it on time and clean. The renter is liable for damage beyond normal wear and tear and for loss.

5. Prices, deposit and payment

The owner sets prices and deposit. Using Mietbar is currently free; we charge no fees. If we introduce fees or payment processing via the platform in the future, we will inform you beforehand and you can decide whether to keep using it.

As long as Mietbar does not offer payment processing, owner and renter agree on payment and deposit directly. Never pay strangers in advance and be especially careful with requests for bank transfers outside the platform.

6. Messages and conduct

• Only use messages for questions and arrangements about rentals.
• Harassment, insults, discrimination, spam and advertising are prohibited.
• You can block other users; blocked users can no longer send you messages or requests.

7. Reviews

After a completed rental, both sides can review each other within 14 days. Reviews become visible once both have reviewed or the period has ended. Reviews must be honest and factual and must not contain insults or personal data. Bought or fake reviews are prohibited.

8. Reports and moderation

You can report listings and users with “Report” or by email to hello@myrental.at. We review reports promptly, carefully and impartially. For violations of these terms or applicable law we may remove content, deactivate listings or suspend accounts temporarily or permanently. We inform those affected about the measure and its reasons; they can object by email to hello@myrental.at (Art. 16, 17 and 20 DSA).

9. Liability of Dinusha Rasangi

We provide the platform with great care but cannot guarantee uninterrupted availability. We are only liable for intent and gross negligence; for personal injury also for slight negligence. We are not liable for rental contracts between users, the condition of items or the conduct of other users. Mandatory consumer rights remain unaffected.

10. Taxes

Income from rentals may be subject to income tax or VAT. Each owner is responsible for this; if in doubt, ask a tax adviser. Once we process payments, we may be legally required to report owners' income to the tax authorities (EU directive DAC7).

11. Deleting your account and termination

You can have your account deleted at any time by writing to hello@myrental.at. We can terminate the user agreement with 30 days' notice, or immediately for serious violations. Rentals already agreed between users are not affected.

12. Changes to these terms

We may change these terms if the law or our services change. We inform you about significant changes by email at least 30 days in advance. If you do not object, the new terms apply; we point out this right in the notice.

13. Applicable law and jurisdiction

Austrian law applies, excluding the UN Convention on the International Sale of Goods and conflict-of-law rules. For consumers this applies only insofar as mandatory provisions of the country of their habitual residence are not restricted. Claims against consumers resident in Austria are heard by the court at their place of residence.
